Terms of Service
Last updated
These terms apply to businesses that use Evarmont to answer their calls and take bookings. By creating an account you agree to them.
What the service does
Evarmont answers your incoming calls with an automated assistant, checks the availability you configure, and books appointments in your calendar. The assistant works from the services, hours, and resources you set up. It does not invent availability, and it will say it cannot help rather than guess.
Your responsibilities
- Keep your services, opening hours, and resources accurate. The assistant offers exactly what you configure.
- Tell your customers that calls are answered by an automated assistant and that a written transcript is kept.
- Obtain consent before we send text messages or email on your behalf, and honour opt-outs.
- Use the service lawfully. Do not use it for emergency services, medical advice, or any purpose where a failure to answer could cause harm.
Bookings made by the assistant
A booking is confirmed only once it is committed to your calendar. The assistant does not tell a caller they are booked before that happens. If a booking fails, the caller is told so and offered an alternative.
You remain responsible for honouring appointments the assistant makes on your behalf, and for any refund, cancellation, or rescheduling policy you apply to them.
Messages
Where you enable it, we send appointment confirmations and change links to your customers by text message or email. You are responsible for the lawfulness of that contact, including any registration your carrier or jurisdiction requires. Message and data rates may apply to recipients. Recipients may reply STOP to opt out and HELP for assistance.
Availability of the service
We work to keep the service running continuously, but we do not guarantee uninterrupted operation. Telephony, speech, and hosting providers we depend on can fail. We will not be liable for calls missed during an outage, and we recommend keeping a fallback route for your calls.
Fees
Fees, if any, are those agreed in writing with you. Provider costs you incur directly — for example telephone numbers or per-minute charges — remain yours.
Your data
Your business data and your customers’ information belong to you. We process them to provide the service, as described in our Privacy Policy. You can export or delete them, and we delete transcripts according to the retention period you set.
Suspension and termination
You may stop using the service at any time. We may suspend an account that is being used unlawfully, that is generating abusive call volume, or that puts the platform or its other users at risk. Where we can, we will tell you first.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss, including lost business from a missed or mishandled call. Nothing here limits liability that cannot lawfully be limited.
Changes
We may update these terms. If a change materially affects you we will give notice before it takes effect, and continuing to use the service after that date means you accept it.
